International data transfers
We may transfer your personal data to other Otsuka group companies, service providers and partners located outside of the United Kingdom or the European Economic Area (“EEA”) (as appropriate), for example in the USA or Japan. Please note that countries outside of the United Kingdom or the EEA may not provide the same level of protection for your personal data. How long will your data be kept?
We will retain your personal data for no longer than is necessary for the purposes for which we are processing the data for. This will depend on a number of factors, including:
- any laws or regulations that we are required to follow;
- whether we are in a legal or other type of dispute with each other or any third party which requires the retention of certain data (e.g., when we are subject to a legal hold);
- the type of information we hold about you; and
- whether we are asked by you or a regulatory authority to keep your personal data for a valid reason.
Your rights
You have a number of rights, which apply to our use of your personal data. The availability of these rights depends upon our legal basis for processing your personal data and may be subject to certain conditions and restrictions. In general, these rights are:
| Right | What does it mean? | |
|---|---|---|
| 1. | The right to be informed | You have the right to be provided with clear, transparent and easily understandable information about how your personal data is used and your rights over your personal data. This is provided in this Notice or through other avenues (such as when you contact us via telephone). |
| 2. | The right of access | You have the right to obtain access to your personal data (if an organisation is processing it), and information about the processing of your data. |
| 3. | The right to rectification | You are entitled to have your personal data corrected if it is inaccurate or incomplete. |
| 4. | The right to erasure | This is also known as ‘the right to be forgotten’ and, in simple terms, enables you to request the deletion or removal of your personal data where there is no compelling reason for an organisation to keep using it. This is not a general right to erasure; there are exceptions (for example, where you have withdrawn your consent to the processing of your personal data that we have relied on, and there is no other legal basis for the processing). |
| 5. | The right to restrict processing | You have the right to ‘block’ or suppress further use of your personal data in certain circumstances (for example, if you contest the accuracy of your personal data held by us and we are verifying the accuracy of your data). When processing is restricted, the relevant organisation can still store your personal data, but may not use it further. |
| 6. | The right to data portability | You have the right to receive your personal data in a structured, commonly used and machine- readable format and transmit the data to another controller, where we process the data based on your consent or performance of a contract. |
| 7. | The right to object | You have the right to object to the processing of your personal data, in certain circumstances such as when we rely on our legitimate interests. |
Where your personal data is processed on the basis of your consent, you have the right to withdraw your consent at any time. If exercised, this will not affect the lawfulness of processing prior to withdrawal.
You also have the right to complain to a data protection authority about our processing of your personal data. For more information, please contact your local data protection authority. Contact details for the UK data protection authority (the Information Commissioner’s Office) are available here. A list of data protection authorities in the EEA is available here.
